Navigation limits in Panama boat insurance policies

A navigation limit is the area your boat policy covers. Many Panamanian hull policies are written for Panamanian territorial waters, and a policy bought in Florida may not reach Panama at all. Outside it you can lose cover even if the location did not cause the loss. Check it before a canal transit, San Blas or any offshore passage.

What a navigation limit is

The navigation limit, or cruising area, is written on the declarations page or schedule. It may be a named area ("territorial waters of the Republic of Panama"), a set of coordinates, a distance from shore, or a list of countries. Some limits change with the season.

Courts can enforce these clauses strictly. In Geico Marine Insurance Co. v. Shackleford (11th Circuit, 2019), a US court applied what the National Law Review called the federal rule of "absolute enforcement of express navigational limits" and denied a hull claim for a yacht damaged outside its limit. A Panamanian policy is governed by its own terms and Panamanian law, but assume the clause means what it says.

Common Panama trips and what to check

TripCoastWhat to ask the insurer
Taboga and Las PerlasPacificUsually inside a Panama-waters limit. Check any distance-from-shore limit: Contadora is about 35 nm from Amador.
Coiba and ChiriquíPacificRemote anchorages and long runs. Check overnight and unattended-mooring conditions.
San Blas and Bocas del ToroCaribbeanA Pacific-based boat needs the canal transit and the Caribbean coast covered.
Canal transitBothLock damage, liability to canal property, and whether your own damage in the locks is covered.
Costa Rica, Colombia, Galápagos or FloridaOffshoreOutside territorial waters. Needs an extension or an international policy, often with crew conditions.

The canal transit: a special case

A canal transit puts your boat in locks with commercial ships, rafted to other yachts, with line handlers working your cleats. A German yacht insurance broker describing its Panama Canal cover says the canal requires a declaration of cover, and that liability insurance pays for damage you cause to the locks or a ship. It also says whether your own damage from striking a lock wall, gate or a rafted boat is covered depends on the policy level and should be expressly named.

Ask your insurer three things in writing: is the canal inside the limit, is lock damage to third parties covered, and is your own hull covered in the chambers. Then plan the rest with canal transit costs and lines and fenders.

Arriving with a US policy

Many owners arrive from Florida with a US yacht policy. US policies often define the cruising area as US coastal waters, sometimes with the Bahamas or Caribbean added by endorsement, and some add hurricane-season conditions. Central America, the canal and the Pacific are often outside unless named.

Before you leave, ask for Panama, the canal and both coasts to be named, or move to an international underwriter. The route is covered in sailing from Florida to Panama, and the Florida guide to insurance exclusions explains how US wordings work. A foreign-flagged boat staying on, as described in foreign-flagged boats in Panama, needs cover for as long as it stays.

Other clauses that work like limits

  • Named operators. An unnamed or unlicensed skipper can void cover anywhere.
  • Use. A pleasure policy does not cover paid trips. ASSA's form excludes paid or instructional operations from both its pleasure and tourism uses.
  • Speed. Some insurers ask for the boat's speed and may limit racing or high-speed use.
  • Lay-up and mooring. A policy may name where the boat is kept, or require it to be attended.
  • Crew for passages. Offshore extensions often require a minimum crew.

Reading the clause: four questions

  1. Where exactly does it end? A country name, a coordinate box or a distance from shore. A distance limit can matter on a Las Perlas run or a Coiba passage.
  2. When does it apply? Some limits apply only while afloat, or only in certain months. A boat hauled out in a yard may be under different conditions.
  3. Does it cover the boat in transit? If you ship the boat or move it by road, the policy may need a transport extension.
  4. Who has to be aboard? Some extensions apply only with named, licensed crew.

If the answer to any of these is unclear, ask the broker for the answer in an email you can keep. A conversation at the dock is not cover.

How to extend your cover

Write to your broker with the route, dates, crew and boat details, ask for an endorsement or a temporary extension, and keep the written confirmation aboard. Expect an extra premium and possibly a survey. Ask how long it takes: an underwriter outside Panama may need several working days, so do this before you book a canal date or a weather window. If you are unsure who should insure you, start with boat insurance in Panama.

Your practical starting checklist

  1. Find the navigation limit on your declarations page or schedule.
  2. List every trip planned this year, including the canal and any offshore passage.
  3. Ask the broker in writing whether each trip is inside the limit.
  4. Request an endorsement for anything outside it, with dates and crew named.
  5. Confirm lock damage and own-hull cover before a canal transit.
  6. Keep the endorsement with the boat's papers aboard.

Frequently asked questions

Does a Panama boat policy cover a canal transit?

Not automatically. Ask whether the canal is inside the limit, and whether lock damage and your own hull damage in the chambers are covered.

What happens if I have an accident outside my navigation limit?

The insurer can refuse the claim, even if the location did not cause the loss. US courts have enforced these limits strictly.

Is San Blas covered by a Panama policy?

If the limit is Panamanian territorial waters, usually yes, but a Pacific-based boat must cross the canal to get there. Confirm both in writing.

Do I need a new policy to ship my boat to Panama?

Ask your insurer whether the policy covers the boat while it is loaded, at sea on a ship and unloaded. Many policies need a transport extension or a separate cargo policy.

¿Mi póliza cubre fuera de aguas panameñas?

Muchas pólizas locales indican como límite las aguas territoriales de la República de Panamá. Para Costa Rica, Colombia o una travesía oceánica, pida una extensión por escrito.
