Yes, a foreign owner can put a yacht under the Panamanian flag. A Panamanian lawyer or a Panamanian consulate files the registration with the Autoridad Marítima de Panamá (AMP). A provisional patente and radio licence follow, and the permanent patente is issued in Panama once the title is recorded. No nationality or residence is required.
How the Panama ship registry treats yachts
Panama's Merchant Marine registry is the same register that flags large cargo ships. A cruising yacht that sails regularly outside Panamanian waters is registered in international service (Ley 57 of 2008, Art. 2). The work is split between two parts of the AMP:
- The Dirección General de Marina Mercante (DGMM) flags the yacht and issues the patente de navegación, the radio licence and the registration certificate.
- The Registro Público de Propiedad de Naves records title, mortgages and liens.
Article 3 of Ley 57 lets any natural or legal person register, without any nationality or domicile requirement. Article 15 requires documents carried aboard international-service vessels to be printed in Spanish and English. For a boat that stays in Panama, interior service is simpler; see registering a boat with the AMP.
Who files: lawyer, consulate or resident agent
For international service, Article 13 gives two routes:
- In Panama, through a qualified Panamanian lawyer filing directly at the DGMM.
- Abroad, by the owner or a representative at a Consulado Privativo de Marina Mercante or a Panamanian Economic and Commercial Office.
Either way, the owner appoints a Panamanian lawyer or law firm as resident agent of the vessel (Art. 102). The consulates can also take the preliminary title registration and email it to the registry, according to the AMP's registry page.
Provisional and permanent patente
| Stage | What you get | How long it lasts |
|---|---|---|
| Provisional | Provisional patente and radio licence, issued by a consulate or AMP headquarters | Patente up to 6 months; the AMP's registry page gives the provisional radio licence 3 months |
| Extension | A further term if the regular documents are not ready (Art. 24) | Up to 6 months; more only for justified causes |
| Permanent (reglamentaria) | Regular patente and radio licence, issued only in Panama | Up to 5 years in law (Art. 26); 2 years for pleasure yachts (Art. 98) |
The DGMM's registry page says provisional registration takes about one business day once the file and fee are in. It describes the regular patente as valid for four years, inside the five-year legal maximum. For a pleasure yacht, plan on two-year renewals; see renewing registration. Title is recorded first preliminarily, valid six months, then definitively once it is protocolised as a Panamanian public deed (escritura pública), translated into Spanish where needed.
Documents a foreign owner should prepare
The DGMM's registry page lists:
- A power of attorney for the Panamanian lawyer, authenticated and legalised (apostilled).
- Bill of sale and title deed, for recording at the Registro Público.
- Deletion or cancellation certificate from the previous flag, or a builder's certificate for a new yacht.
- A tonnage certificate from a recognised authority.
- Proof that the yacht owes no taxes to Panama.
- Technical certificates required by convention, and the radio licence application.
For a pleasure yacht, Article 97 adds an original sworn declaration of non-commercial use, legalised by the consul if signed abroad. A US owner leaving USCG documentation must close that first; the Florida side is in documenting a vessel with the USCG.
Private yacht or commercial yacht
The sworn non-commercial declaration is what makes the yacht private. A privately registered yacht cannot take paying guests. If chartering is in the plan, you have two paths. One is commercial registration and an operating licence; see pleasure vs commercial registration. The other is placing the yacht with an AMP-licensed charter company under Resolution J.D. 089-2020 and Decreto Ejecutivo 4 of 2025. That decree's charter permit is open to Panamanian-registered yachts holding an international-service patente.
The flag does not settle customs
A Panamanian flag does not mean the yacht has been imported. A yacht that lives in Panama is either in transit (up to 24 months under Decreto Ejecutivo 4 of 2025) or imported with duty and ITBMS paid. See in transit vs imported. Article 99 of Ley 57 also requires international-service vessels navigating in Panamanian waters to carry a navigation permit from the DGMM, so ask your lawyer which permit applies to your cruising plans.
A reform of Ley 57 went to the Asamblea in February 2024. TVN reported it would give patentes a digital number, a QR code and no expiry date. Check with your lawyer whether it has passed before you plan renewals.
Your practical starting checklist
- Decide private or commercial use, and how the yacht will stand with customs in Panama.
- Appoint a Panamanian lawyer as resident agent and sign an apostilled power of attorney.
- Close the previous registry and obtain the deletion certificate, or the builder's certificate for a new build.
- File for provisional registration through the lawyer or a Panamanian consulate and pay the fees.
- Record the title at the Registro Público by public deed within six months.
- Apply in Panama for the regular patente and radio licence before the provisional documents expire.
Frequently asked questions
Can I register a yacht in Panama without living there?
Yes. Ley 57 sets no nationality or residence requirement. You act through a Panamanian lawyer as resident agent, or file through a Panamanian consulate.
How fast is Panama yacht registration?
The AMP says provisional registration takes about one business day once the file is complete and the fee is paid. The permanent patente follows after the title is recorded in Panama.
Does a Panama-flag yacht need a radio licence?
Yes. The DGMM issues a provisional radio licence with the provisional patente and a regular one with the permanent patente. Details are in the radio licence guide.
Can I keep my yacht's name when I move it to the Panama flag?
Usually, if no other vessel on the Panamanian register already uses it. Article 9 of Ley 57 bars duplicate names, and Article 12 lets you reserve a name in advance. See the guide on boat names and markings.
Does a Panama flag let me stay in Panama indefinitely?
No. The flag is about registration, not customs. A yacht kept in Panama is either in transit, for up to 24 months under Decreto Ejecutivo 4 of 2025, or imported with duty and ITBMS paid.
