A charter is illegal in Panama when any link in the chain is missing: no ATP registration, a boat on a pleasure patente carrying paying guests, no AMP operating licence, an unlicensed or expired captain, a foreign yacht chartering without the 2025 permit, or more people than the certificate allows. The AMP and SENAN enforce at docks and at sea.
What makes a charter illegal
- Unregistered tourism operator. Selling boat trips to tourists is marine tourist transport, which the ATP registers under Decreto Ejecutivo 82 of 2008. Operating without that registration, or without an aviso de operación, is outside the system.
- Pleasure-registered boat carrying paying guests. Under Ley 57 of 2008 a pleasure craft is registered on a sworn declaration that it will not be used commercially. Taking money for a trip on that boat breaks the declaration.
- No AMP operating licence. The AMP says only vessels with a valid passenger-transport operating licence may carry passengers, and those without one may not sail or board them.
- Unlicensed or expired captain. The captain needs an AMP licence for the boat and its service; a US licence on its own is not one.
- Foreign yacht chartering without the permit. Decreto Ejecutivo 4 of 2025 allows a foreign recreational yacht to charter only through a local company holding the AMP yacht-leasing licence, with a temporary charter contract and a charter navigation permit.
- Overloading. More people than the safety certificate allows is an infraction even for a fully licensed boat.

Who enforces, and how
| Agency | What it does |
|---|---|
| AMP (Marina Mercante and ports directorate) | Inspects boats, checks patentes, operating licences and crew licences, sanctions infractions |
| SENAN (Servicio Nacional Aeronaval) | Boards boats at sea and at docks, runs joint operations with the AMP, receives passenger manifests |
| ATP | Registers and supervises tourism businesses |
| ACP | Enforces its small-craft rules in Canal waters |
Enforcement is most visible on holiday weekends. The AMP ran joint inspections with SENAN in Bocas del Toro in 2024 that found several expired licences, cited a boat with expired navigation permits and an expired operator licence at Pedregal the same year, and at Carnaval 2026 reported operators preparing to carry more passengers than allowed. On the Amador causeway SENAN boards boats and asks for registration, the operator's licence and the safety gear. More on the agencies is in enforcement in Panamanian waters.
Penalties: what the law says and what it does not
Ley 57 of 2008 sets the AMP's sanction framework. Sanctions can fall on the vessel, the owner, the operator and the captain. A minor infraction draws a written warning; a serious or repeated one draws a fine. The fine amounts are set by the AMP's board, and when a fine is imposed on the owner, operator or captain, the vessel is jointly liable for it. To appeal a fine you must pay or deposit the amount within ten business days.
The AMP does not publish its fine schedule online, and none of the enforcement reports we found states an amount. Confirm current fines with the AMP before you quote a figure to anyone. Beyond fines, the practical consequences are a boat held at the dock, cancelled trips, a citation to appear at the AMP, and an insurer with grounds to refuse a claim. For the guests, it can mean a ruined day, stranded on a dock or a beach with no refund.
How guests can spot an illegal charter
Ask before you pay. A legitimate operator can show:
- The company's ATP registration.
- The boat's AMP patente for commercial service, not a pleasure permit.
- The company's AMP operating licence. The AMP publishes a list of companies with current operating licences, updated on the 15th and 30th of each month.
- The captain's AMP licence.
- The name of the insurer.
Warning signs: pickup from a beach or an unmarked dock, a 'trip with friends' story when you are clearly paying, more people than seats or life jackets, no manifest or ID check, and a refusal to give the boat's name. The guest's view of a normal day is in Panama City boat tours: what to expect.
How legitimate operators protect themselves
- Keep every document current and aboard, and diarise the expiry dates.
- Check your company appears on the AMP's operating-licence list and keep a dated copy.
- File the SENAN manifest for every departure and keep copies.
- Board only at docks where you have a written agreement; see pickup locations.
- Never lend your boat to someone who will charge guests under your papers.
- Put your ATP and AMP details on your website and confirmation emails, so guests can check.

Your practical starting checklist
- Ask for the ATP registration, AMP patente and operating licence before paying.
- Check the company on the AMP's list of current operating licences.
- Confirm the captain holds an AMP licence.
- Count the life jackets against the people boarding.
- Board only at a marina, not a beach.
- If you are the operator, keep every document current and aboard.
